Certificate in Refugee Class Immigration Law Overview

The Certificate in Refugee Class Immigration Law is intended to provide the fundamental knowledge necessary for professionals to deal with refugee proceedings at a Port of Entry, in Canada, or Applying from Abroad. It is designed to bridge theory and knowledge with practice, introducing learners to dealing with refugees within a professional working environment. The focus is placed on refugee class cases within the practice of Immigration Law, preparing learners with strategies of approach, case studies and discussions led by experts in this field.

Topics/Learning Objectives

Upon successful completion of this course, students will be able to:

  • Identify and explain the elements that must be established for a person to be found A) a Convention refugee under IRPA s. 96; and B) a protected person pursuant to IRPA s. 97
  • Articulate the process and procedure for preparing a refugee claim at three essential stages: A) basis of claim; B) hearing before the RPD; and C) appeal to the RAD
  • Identify common reasons that refugee applications fail, and articulate strategies for addressing those potential shortcomings
  • Map out the timeline of a refugee claim through its most common permutations from the initial claim to removal or designation of protected status
  • Ask questions that will give you the information you need to assess the viability of a refugee claim
  • Make a realistic strategic assessment of a client’s claim based on interview questions and document analysis
  • Conduct a thorough analysis of relevant sections of the Immigration and Refugee Protection Act (IRPA) and the Immigration and Refugee Protection Regulations (IRPR)
  • Reference and analyze the case law relating to relevant sections of the Immigration and Refugee Protection Act (IRPA) and the Immigration and Refugee Protection Regulations (IRPR)
  • Develop a personal and professional approach to a Refugee claim
  • Engage in in-class practicums consisting of scenario-based discussions and simulations

Admission Requirements

Although there are no formal admission requirements for this course, due to the advanced nature of the material covered, it is presumed that attendees have a basic knowledge of Canadian Immigration Law in general and this topic in particular.

Credential

Upon completion of the course requirements, a Certificate of Completion will be issued.

Live Online Students

Ashton College uses web conferencing tools for conducting online classes and online learning management systems for managing resources, assignments, and grades. These tools help instructors and students connect live online as well as asynchronously. The basic requirements for online learning include a computer, webcam, speakers, and a microphone or a headset and headphones, along with a reliable internet connection. Though online learning can be pursued using smartphones and tablets, the use of laptops or desktop computers is encouraged for an enhanced learning experience.
